Amsterdam, 14 December 2012 – Two conscientious objectors involving the Dutch East Indies are requesting the
Supreme Court to review their sentences of 1950 and 1951 respectively.

Jan Maassen (1929) and Johannes van Luyn (1925), in 1949 and 1946 respectively, refused on grounds of principle
to go to the then Dutch East Indies, to participate there in the so-called 'police actions'. They refused to participate
in the shooting and killing of innocent citizens. Maassen: "I would only wish to go to Indonesia to prevent my
comrades from shooting defenseless Indonesians."

On 3 May 1950, Maassen was sentenced by the Supreme Military Court to 3 years imprisonment for "wilful
disobedience, committed in times of war". By order of the Minister of Justic, he was later excluded from the right to
vote until 5 September 1955. On 9 January 1951, Van Luyn was sentenced to 2 years imprisonment.

At the time of the trial of both men in the nineteen-fifties, the military court was by no means aware of the
structural violence of Dutch soldiers against citizens in the Dutch East Indies. The crimes committed by Dutch
soldiers during the police actions became apparent only after the publication of the Report on Excesses in 1969.
Moreover, later research has shown that these do not concern incidental misdeeds, but large-scale systematic
actions which Dutch soldiers could not avoid.

having to participate in committing (war) crimes. Seeing as this concerns facts which have only become apparent
until many years after the sentencing, Maassen and Van Luyn ar of the opinion that this is a matter of a new point
of law (Section 457, paragraph 1 of the Dutch Penal Code).
