AMNESTY INTERNATIONAL DEMANDS NEW PROBE INTO MUNIR DEATH

London-based rights group Amnesty International has urged the Indonesian
Attorney General's Office (AGO) to initiate a new investigation into the
alleged murder of Indonesian rights activist Munir Said Thalib in 2004.
Sixteen country directors of Amnesty signed a letter sent Tuesday to
Attorney General Basrief Arief, urging that he make the investigation a
priority.
"Although two people have now been convicted of the killing, there are
credible allegations that those responsible at highest levels have not
yet been brought to justice.
"The lack of accountability in Munir's case contributes to an ongoing
sense of fear among human rights defenders in Indonesia," Amnesty says
in the letter, a copy of which was sent to /The Jakarta Post.
The rights group also criticized the acquittal of Muchdi Purwoprandjono,
a former deputy at Indonesia's State Intelligence Agency (BIN), in a
court hearing in 2008 in relation to the murder case.
"At the time, human rights groups said the trial did not meet
international standards of fairness after key prosecution witnesses
retracted their sworn testimonies," Amnesty said.
Amnesty made the call ahead of the seventh anniversary of the death of
Munir, on Wednesday.
Munir was found dead on a Garuda Indonesia flight from Jakarta to the
Netherlands on September 7, 2004. An autopsy carried out by Dutch
authorities showed that he died as a result of arsenic poisoning.

MUNIR KILLER CASE REVIEWS SET TO COMMENCE

Pollycarpus Budihari Priyanto, a Garuda pilot convicted for his role in
the murder of human rights activist Munir Said Thalib, has been granted
a case review, set to begin on Tuesday at Central Jakarta District Court.
The case review will challenge a Supreme Court ruling that found
Pollycarpus guilty of premeditated murder, and sentenced him to 20 years
in prison.
Pollycarpus was initially sentenced to 14 years in prison by Central
Jakarta District Court for killing Munir using arsenic poison. Later,
the Supreme Court overturned the verdict, finding him guilty of only
falsifying documents and reduced his sentence to two years in prison.
The Attorney General's Office (AGO) then filed a case review petition to
overturn Pollycarpus' acquittal. The Supreme Court granted the petition
in 2008, finding the former pilot guilty of premeditated murder and
sentenced him to 20 years' imprisonment.
The case review requested by Pollycarpus, and subsequently granted by
the Supreme Court, has upset rights activists who believe it is a plot
to exonerate people responsible for the death of Munir, who died aboard
a Garuda Indonesia flight on route to Amsterdam in 2004. (awd)

The Commission for Missing Persons and Victims of Violence (Kontras)
said that it condemned the government for erasing resolution of the
murder case of human rights activist Munir Saib Thalib from its list of
priorities. Munir died of arsenic poisoning on board a Garuda Indonesia
flight to Amsterdam in 2004.
The condemnation came during the approach of the seventh anniversary of
Munir's murder, which falls on September 1.
"There have been so many dynamics within the Munir case over these seven
years. However, over the last three years, the justice agenda has ended
in weakening the law on" Kontras coordinator Haris Azhar said on Monday
in a press statement to The Jakarta Post.
"The Supreme Court has freed Muchdi Purwoprandjono and gave Pollycarpus
a number of prison sentence reductions that have been challenged based
on accusations of obscure and vague reasoning," he added.
Pollycarpus Budihari Prijanto, who was sentenced to 20 years
imprisonment in 2008 for the pre-meditated murder of Munir, has been
granted remissions every Independence Day and Christmas Day since his
imprisonment. He recently received a 9 months and 5 days remission on
Independence Day.
Muchdi, who was the former deputy chairman of the State Intelligence
Agency (BIN), was put on trial for Munir's murder but has been declared
innocent.
He further said that it was befitting that President Susilo Bambang
Yudhoyono, the Supreme Court, the Attorney General's Office and the Law
and Human Rights Ministry "sit together and evaluate progress made in
this case and ensure that justice is fulfilled".
"We are concerned that if President Susilo Bambag Yudhoyono remains
quite and law enforcers mum, the Munir case would be erased from notes
on legal processes. Those responsible will be free, physically and
politically, meaning that there would not be any correction on that
crime for Indonesia's law and justice in the future," he added.

VERDICT, CASE SUSPICIOUS, SAYS POLLYCARPUs

Pollycarpus, a Garuda pilot convicted for his alleged role in the murder
of rights activist Munir, says a Supreme Court verdict, sentencing him
to 20 years in prison, is "peculiar".
"There are many odd things about the verdict," Pollycarpus said before a
case review hearing at Central Jakarta District Court on Tuesday.
Pollycarpus' lawyer, M. Assegaf, said the earlier trials of his client,
which eventually led to the 20-year sentence, were marred with controversy.
"Since the initial trial, there has been various disagreements between
judges," Assegaf said, explaining that the chief judge had found
Pollycarpus innocent, but this had been overruled by other judges.
"There was also [controversy] in the high court trial that acquitted
Polly," he said.
Assegaf also protested the case review appeal launched by prosecutors,
granted by the Supreme Court, saying prosecutors had no right whatsoever
to request a case review.
"The right for a case review, by law, only belongs defendants and their
relatives," he said.
Pollycarpus was convicted for the premeditated murder of Munir, after he
was accused of putting arsenic into Munir's drink at Singapore's Changi
Airport.

SUCIWATI TO CHALLENGE POLLYCARPUS 'REMISSIONS'

JAKARTA: Suciwati, widow of slain human rights defender Munir Said
Thalib, is seeking to overturn the decision by the Law and Human Rights
Ministry to grant remissions to the killer of her husband, an activist says.
"We have filed an official request to the Law and Human Rights Ministry
asking for copies of the ministerial decrees, that granted Pollycarpus a
number of cuts to his sentence," the chairman of the Commission for
Missing Persons and Victims of Violence (Kontras), Haris Azhar, told The
Jakarta Post.
Haris was referring to former pilot Pollycarpus Budihari Prijanto, who
was sentenced to 20 years' imprisonment in 2008 for the premeditated
murder of Munir, Kontras' founder.
According to data compiled by Kontras, the government has reduced
Pollycarpus' jail term by almost 25 months through seven remission grants.
"The government should have applied stiffer conditions for a human
rights convict like Pollycarpus," said Haris.A spokesman for the Law and
Human Rights Ministry, Martua Batubara, said the ministry would be ready
to face the lawsuit.
Munir died from arsenic poisoning on board a Garuda Indonesia flight to
Amsterdam in 2004.

ACTIVISTS CRITICAL OF NEW 'OLD' EVIDENCE IN POLLYCARPUS CASE

Khoirul Anam of the Solidarity Action Committee for Munir (Kasum) said
the purportedly new evidence brought to court by Pollycarpus and his
lawyers was nothing new.
In an effort to have a Supreme Court ruling overturned, Pollycarpus and
his lawyers offered five new pieces of evidence in their case review.
Among the new evidence proposed was an aircraft flight log confirming
the Singapore-Amsterdam flight hours and witness testimony that
Pollycarpus went straight to a bus as soon as he got off a Garuda flight
from Jakarta.
"[The evidence] is nothing new. Previous witnesses Sabur M. Taufik and
Brahmani Hastawati already testified that Pollycarpus was on the same
bus as them," Anam said after the hearing on Thursday.
"As for the hours of the flight, that was also explained by previous
witnesses Pantun Matondang and Madjib Rajab Nasution," Anam said.
Anam questioned the use of that evidence in a case review, in which only
new evidence is to be accepted.
"They should be careful in passing that as new evidence. It was used and
rejected in the previous trial. If they use it again, it means they are
just playing around," he said.
"It should not be taken as valid evidence," he added.
The Supreme Court found Pollycarpus guilty of the premeditated murder of
human rights activist Munir by putting arsenic in Munir's drink at
Singapore's Changi Airport. He was sentenced to 20 years in prison.
Pollycarpus has challenged the court's sentence with a case review. (awd)
