THE Iranian woman whose sentencing to death by stoning for adultery has sparked international outrage may be hanged for murdering her husband.

The Iranian regime appears to have reopened a charge of murder against Sakineh Mohammadi Ashtiani. Comments by government officials have raised fears that Tehran is seeking a pretext to execute the 43-year-old mother of two without appearing to cave in to international pressure over the sentence of death by stoning.

Gholam-Hossein Mohseni-Ejei, the national prosecutor-general and spokesman for the judiciary, announced this week that Ms Ashtiani faced death for her role in her husband's murder in 2005, saying the sentence would take precedence over the conviction for adultery.

"According to the court's ruling, she is convicted of murder and her death sentence has priority," he said in comments reported by the semi-official Mehr News Agency.

At a press conference yesterday, however, Ramin Mehmanparast, a Foreign Ministry spokesman, insisted that Ms Ashtiani's case was not complete, but his comments made clear that the government was still pushing for a murder charge against her.

"Right now what we are pursuing is the topic of murder, and her participation in murder is confirmed. The judicial process has not been completed as yet and the conviction will be issued after full review of the case," he said.

The murder case against Ms Ashtiani remains mired in confusion. Essa Taheri, her cousin and alleged lover, was convicted of her husband's murder but released when her family waived their right to seek blood money for the killing. Ms Ashtiani was subjected to 99 lashes and, according to some reports, sentenced to 10 years in prison, later reduced to five years, which she has almost served.

Under the penal code, the murder case cannot be reopened unless there is a new plaintiff or new evidence. However, the statements from Tehran suggest that the government is seeking any justification to execute Ms Ashtiani without her stoning.

The strength of the outcry in the West has been credited with delaying the stoning, despite Tehran's professed indifference to international opinion. Visiting New York last week, President Mahmoud Ahmadinejad used interviews with US media to deny Ms Ashtiani had been sentenced to stoning, instead blaming Western media and politicians for stirring up propaganda.
